Pre-charge Representation May be Critical.

It was very late when the call came in. I could hear it in his voice. He was scared, distraught, and also outraged. Somebody was claiming that he had sexually assaulted them and he absolutely had not. He told me he wasn’t sure what to do so he called me. I’m a sex crimes lawyer so this is nothing new.

This is called pre-charge representation. Sometimes, before the police have been called or even if they have and no charges have been filed, I receive phone calls like this. In fact, if I had my druthers, this is when I wish I would always be pulled into a case. For one reason, I am able to legally wrap a wall of protection around my client to control statements and to some degree the investigation. However, one of the main reasons this matters so much is that I get to move forward with an investigation of my own to determine exactly what was going on before the police “decide” what happened..

After a few weeks, I was able to find additional evidence to not only support that my client wasn’t responsible but also that it was actually impossible. All of this evidence ended up on the desk of the Commander of the Sex Crimes Unit. After multiple meetings and even more evidence, we knew that it was only a matter of time. As a result, the government decided not to even charge the case itself.

The benefits of this are obvious. Understand the massive impact being pulled through the mud by false charges. Sometimes, whether they are false is irrelevant and it is too late. People lose jobs, relationships, careers, friendships, reputations. We avoided all of that and my client was able to go back to living his life. He was innocent and this was as it should be.

While every case is different, if you find yourself in this situation, whether it is a sex crime, domestic assault, violent crime or anything else, pick up the phone and call Jack Rice Defense before you even respond to a call from authorities. It may very well be the most important call that you ever make.

Jack of Jack Rice Defense is a St. Paul based Sex Crimes Lawyer.
