Tackling Columbus, Systemic Failures in Equity: A Closer Look at State v. Forcia

As part of the Hennepin County Bar Association (HCBA) Diversity Committee/s CLE Series on Racial Equity and Justice, Willow Najjar Anderson and Jack Rice will teach a program on May 26, 2022 called Tackling Columbus, Systemic Failures in Equity: A Closer Look at State v. Forcia.

According to the HCBA:

Civil unrest following the murder of George Floyd in 2020 led to protests across the nation, one of which resulted in the toppling of the Christopher Columbus statue on the grounds of the Minnesota State Capitol by American Indian Movement activist Michael Forcia. Mr. Forcia was charged with felony Criminal Damage to Property. 

Criminal defense attorney, Jack Rice, and public health law attorney, Willow Anderson, joined forces to take on this case pro bono.  Working with the Ramsey County Attorney's Office, they collaborated with community leaders to determine a restorative justice process that would give voice to community members on how to best hold Mr. Forcia accountable while healing the community and discussing the multiple branches of failure that led to this action.  

In dismissing the charges, Chief Judge Leonardo Castro stated, “True justice and healing are rarely achieved but I sincerely believe that it was so in this case.  It would have been simple to charge, convict, and punish.  But the more difficult road towards reflection, learning, and healing was taken, and the result will bear fruit forever.  I congratulate you all for your wisdom and courage.”

Thomas Lane was getting ready to go on trial on June 13th with his two co-defendants for aiding and abetting the murder of George Floyd. They have already been convicted in Federal Court for other charges but this was the original set of charges that they faced following the conviction of Derek Chauvin.

Lane made the decision on 5/17 to plead guilty rather than going to trial. This was Lane’s right but it is always complicated to decide which direction to go when facing serious felony charges like murder in Minnesota Criminal Court. Last week, Amber Heard dropped a bombshell into her testimony about an old relationship where Johnny Depp allegedly threw Kate Moss down the stairs during an argument. This information was not something that Amber Heard was present for but rather something she claims she heard about. The problem is that this information is what is called a “prior bad act.”

According to Rule 404b of the Rules of Evidence, this kind of information is inadmissible. Often, if one side does this, it opens up the evidence which could allow Depp to call Kate Moss to come in and support Depp and refute Heard’s claim. However, and even worse for Heard, this may allow Depp to bring in Heard’s prior bad acts including her previous conviction for domestic assault. Considering that this case is really about domestic assault in many ways, this could be devastating for the Heard team. Johnny Depp is suing Amber Heard for defamation and Heard is suing Depp right back. The case goes back to 2018 when Heard wrote an OPEd in the Washington Post about being a victim of domestic violence. Even the Court made it clear that there was little doubt that it was directed at Depp. Depp is claiming damages but the broader question is whether this lawsuit actually damages Depp even more.

Venue Can Be Incredibly Important in Some Criminal Cases - AM 950 Appearance

Four men were charged with planning to kidnap the sitting Governor of Michigan. If the stories were to be believed, the four men planned to kidnap the Governor at her vacation home on an island, blow up the bridge to slow authorities and then either murder her by hanging up by dropping her in the middle of Lake Michigan. Two of those men were found not guilty and the other two had hung juries.
