The jurors in the Kim Potter manslaughter trial have just finished day 2 of deliberations with q question for the Judge. “What happens if we can’t agree? This is a common question but it is potentially also a monumental one. After more than 15 hours of deliberations when you have a brutal video on one side alongside a distraught police officer and a couple of witnesses who said she was justified to use deadly force on the other, this is a question that has few simple answers. The only phrase that comes to mind is possible “hung jury.”

Nationally known Criminal Defense Attorney Jack Rice appears on KSTP TV as that question is being asked of the judge. Jack explains that a hung jury means that there is no unanimous agreement. In Minnesota, all of the jurors, all twelve of them, must agree. If they don’t, it means that the judge will push them but if they still can’t decide, they may have to do the whole thing again or . . . not. This is the question. Kim Potter could walk.
