Jack Appears on Court TV to talk Cross Examination and the Depp/Heard Trial

“Be Brief. Be Brilliant. Her Seated.” Cross examination is about declarative statements, one fact at a time. This is about the Attorney testifying, not the person they are cross examining on the stand. You aren’t fighting. You are controlling.

Jack Rice appears on Court TV on 5/23/22 to discuss cross examination and how you handle a difficult witness. Considering the massive egos in the courtroom in the Johnny Depp/Amber Heard case, this is no small feat. However, this is necessary.

Jack Rice Appears on KSTP to talk about Plea Agreements and the Chauvin Co-Defendant Plea in Minneapolis

Thomas Lane was getting ready to go on trial on June 13th with his two co-defendants for aiding and abetting the murder of George Floyd. They have already been convicted in Federal Court for other charges but this was the original set of charges that they faced following the conviction of Derek Chauvin.

Lane made the decision on 5/17 to plead guilty rather than going to trial. This was Lane’s right but it is always complicated to decide which direction to go when facing serious felony charges like murder in Minnesota Criminal Court. There are series of difference issues that should be considered when deciding whether to go to trial versus pleading guilty to anything. If you are facing such charges, make sure that you sit down with an experienced Minnesota criminal defense attorney.

“Going to trial is a client’s Constitutional right. At the same time, knowing what happens if you win or lose can be equally important. What do you risk if things go wrong? Are there alternatives?”

Criminal Defense Attorney Jack Rice sat down with Callan Gray of KSTP TV to talk about Thomas Lane’s decision to plead and to talk about the process one goes through to make a decision like this. We talked about the risks versus rewards of going to trial and the potential exposure of losing.

If you are facing serious charges, talk with a criminal defense attorney who can give you an assessment of your case, the exposure you might face and the various avenues that you might take. Knowing your options is everything.

Jack Rice Appears on Law & Crime to Discuss Prior Bad Acts Evidence and Trial Advocacy in the Depp/Heard Trial

Jack Rice Appears on Law & Crime to Discuss Prior Bad Acts Evidence and Trial Advocacy in the Depp/Heard Trial

Last week, Amber Heard dropped a bombshell into her testimony about an old relationship where Johnny Depp allegedly threw Kate Moss down the stairs during an argument. This information was not something that Amber Heard was present for but rather something she claims she heard about. The problem is that this information is what is called a “prior bad act.”

According to Rule 404b of the Rules of Evidence, this kind of information is inadmissible. Often, if one side does this, it opens up the evidence which could allow Depp to call Kate Moss to come in and support Depp and refute Heard’s claim. However, and even worse for Heard, this may allow Depp to bring in Heard’s prior bad acts including her previous conviction for domestic assault. Considering that this case is really about domestic assault in many ways, this could be devastating for the Heard team. If you are facing serious criminal charges in Minnesota, contact an experienced criminal defense attorney.

“If you open up the door and bring in inadmissible evidence, the court could easily allow the other side to bring in their own. If you’re hiding a domestic assault conviction in your past, the jury may see it in all its glory.”

Jack Rice appears on Court TV on Wednesday, May 11, 2022, to discuss evidence, trial advocacy and how these things can really matters in trials. Further, Jack will discuss the ramifications of violating the rules and what might happen next.

Venue Can Be Incredibly Important in Some Criminal Cases - AM 950 Appearance

Four men were charged with planning to kidnap the sitting Governor of Michigan. If the stories were to be believed, the four men planned to kidnap the Governor at her vacation home on an island, blow up the bridge to slow authorities and then either murder her by hanging up by dropping her in the middle of Lake Michigan. Two of those men were found not guilty and the other two had hung juries.

Jack appears on AM 950 in Minneapolis to discuss the trial and why things turned out as they did. In the end, it was a question of venue as well as a general credibility problem for law enforcement. The trial took place on Grand Rapids, Michigan which is generally far more conservative and the alleged motivation behind the plans was political in nature. This venue was exactly the kind of community that the defense wanted in order to present their case. Even further, the generally decline in the credibility of law enforcement has impacted many criminal trials across the country, both left and right.
