Jack Talks Jury Selection and Why it is so Critical in Minnesota on AM 950

It goes without saying that having a fair jury matters in a criminal trial in Minnesota. That said, that doesn’t always mean that it happens. Picking a fair trial, sometimes called jury selection, sometimes called voir dire, is a lot more complicated than people may realize. Consider, what happens when somebody isn’t completely forthcoming during questioning? What happens if they downright lie in order to get on that jury. Worse, what happens when they get on the jury with the intention of driving the verdict one direction or another. Its called implicit bias andtin the last couple of years, the Minnesota Supreme Court decided to include the definition of implicit bias into jury instructions to help jurors understand this potential form of racism. Of course, there is the good old-fashion racism that is still alive and well.

While this issue is critical, it is equally important for Jack Rice’s clients of color who face jury trials and desperately need fair jurors. Talking about racism and sometimes even calling it out is a scary but necessary piece of trying cases. Without it, BIPOC people face even greater odds. In the end, it isn’t just a BIPOC problem, it is an American one.

When Picking a Jury, Know What You are Looking For - Law & Crime Appearance

Standing in front of a jury is a really interesting and unusual exercise. For many years and dozens and dozens of trials, I used to think of it as an effort to find people who would find your client not guilty. Even more, I tried to limit to impact of others saying things I didn’t want to hear. I was wrong.

“When I’m picking a jury, I’m hunting.”

As I stand before a group of potential jurors now, I know what I’m looking for. I’m hunting. What is my theory, what is my theme? I then think about people who see the world in this similar way. This way, when I say something, people will viscerally agree.

As jury selection continues to progress in the Derek Chauvin murder trial, I will appear on WCCO Radio with Jearlyn Steele to discuss the challenges of picking a fair jury in impossible circumstances. The attorneys need to pick twelve jurors plus several alternatives. There have been a lot of strikes for cause, meaning that the Judge determined that the potential jurors simply couldn’t be fair and impartial. The prosecutors have nine strikes and the defense has fifteen. We will talk about what goes through the minds of attorneys trying to find a jury that will do what you want them to do.

Exactly how do you pick a jury when they’ve all decided. A look at the George Floyd murder case.

Jury selection is scheduled to begin on March 8th in the Derek Chauvin case here in Minneapolis. Imagine hundreds of people being brought in to potentially sit in judgment on one of the most closely followed trials on the planet. However, how exactly do you pick an independent jury if everybody has made up their minds before they even get to the courthouse? I guess the first question is, have they? Maybe the second is, really? I will appear on WKBK with Dan Mitchell to discuss exactly how challenging it can be to pick a jury in a high profile case like this.

If you have followed the Chauvin case, you likely have your own opinions by now. Is that good or bad? If you don’t, is that worse? If you are afraid to say, isn’t that the worst of all if you are trying to figure out what is in the heads of potential jurors. These are just a few of many challenges lawyers on both sides face.
