Can a Defendant Get a Fair Trial in This Environment? Jack Appears on WCCO to Discuss

Judge Cahill moved the criminal trials of the three remaining former police officers in the George Floyd case to March of 2022. At the same time, the Feds have charged several of those officers including Derek Chauvin with new charges. This will put pressure on these defendants to potentially find resolution in these cases. It also brings up the question of how much pressure there will be on the Attorney General’s office to go ahead with those prosecutions. We will see.

I appear on WCCO with John Hines to discuss the jury system, fairness and whether or not it is even possible in a case like this. Hope you can catch it.

Prosecutor Use of Social Media can be Catastrophic in Minnesota Criminal Cases. Jack talks to CBS News

Social media is everywhere. It is almost impossible to miss it no matter how hard you try. Now, imagine what happens if you, like almost anybody on the planet, actively takes part in it? Consider the photos you take, the places you go, the things you write and more. Now, imagine if you get charged with a crime in Minnesota and prosecutors want to look at public social media to figure out who you are, where you go, what you do, who you know, everything. Crimes could include everything from DWI< domestic assault, drug crimes, rape and sexual assault and even murder.

It is amazing to realize that technology originally used to fight international terrorism organizations could then be turned around and used right here in the U.S. to prosecute people.

Jack Rice is a former CIA Case Officer and a Minnesota based criminal defense lawyer. He was recently contacted by CBS News in Salt Lake City because four more people have been arrested there and tied to the January 6 riot at the Capitol in Washington DC. Jack talked about facial recognition software and how it was used in the intelligence community and then developed and transferred and used by the FBI in terrorism cases. Now, they use that same sophisticated technology and cross referencing it with social media in other criminal cases. Cases just like yours. Jack has seen this happen in Minnesota criminal cases.

Jack Rice is the founder of Jack Rice Defense, a Minnesota based criminal defense firm. As a former CIA Officer, he has a unique understanding nationally when it comes to this kind of technology. As a former prosecutor, he contemplates how this may impact a criminal case. As a criminal defense attorney, he has to fight against what the government is trying to do to his clients.
