Sometimes it is a race to the prosecutor's door. However, sometimes, the prosecutor in a criminal case in Minnesota has already decided who they are really going after. As a result, they will focus on building that case. There are times when others could be charged and may avoid more serious charges or even avoid any charges at all. The trick is understanding what the prosecutor really wants and needs.

“Negotiating a plea is sometimes about the strength of the state’s evidence. Sometimes it is about getting somebody else. Sometimes it is about numbers. Knowing which is which is important.”

St. Paul based defense attorney Jack Rice appears on Court TV on 6/28/22 with Judge Ashley Willcott and Lawyer Josh Schiffer to discuss sentencing, evidence and how evidence may help in negotiating sentences. Sometimes, the state wants something else and the trick is finding out how to give it to them.

“Knowing the players, the prosecutors and the judge can really help. You know how they work, what they are trying to accomplish and what they may even want from you.”

The State may or may not really want you. They may just want what you know. Regardless, it is critical to talk with an experienced criminal defense attorney about this process. It isn't simple and it isn't easy. Your attorney should know how what you know would help the state. This can make all of the difference.
