Should I try my case before a Judge or a jury? This is an age old question and the answer may be just as old - it depends. Bench trials are different than jury trials. Yes, contrary to popular belief, judges are people too. That's a joke - sort of. However, because of their training, they should process information slightly differently than a jury might. Also, when a judge is also the fact finder, there is no space between the fact finder and the legal arbiter. This is important to remember. If you are facing serious criminal charges in Minnesota, there are times when, because of the allegations, a bench trial may be more beneficial. Make sure you sit down with an experienced Minnesota criminal defense attorney.

“There may be cases with particularly brutal facts that might drive a jury that may be better before an experienced and maybe cynical judge. “

Jack Rice appears on Court TV on 4/22/22 to discuss the differences between a court trial and a jury trial. Further, he discusses how he changes his approach for both.
