Under Minnesota law, anyone operating a motor vehicle with a blood alcohol concentration (BAC) of .08 or higher can be charged with DWI—regardless of age. Minnesota’s Zero Tolerance Law: "Not a Drop"

Minnesota enforces a Zero Tolerance or “Not a Drop” policy for drivers under 21. It is a misdemeanor offense for anyone under the legal drinking age to operate a vehicle after consuming any amount of alcohol. In practice, law enforcement typically looks for a BAC over .02 to file charges, but even a trace amount can lead to arrest.

If convicted, an underage driver faces up to 90 days in jail, a $1,000 fine, and probation, often including an alcohol education program.

License Revocation and Other Consequences

A conviction for underage drinking and driving carries significant administrative penalties:

  • 30-day license revocation for a first offense

  • 180-day revocation for a second offense or if the BAC exceeds the legal limit for adults (.08)

Additionally, a conviction can delay or restrict the ability to obtain an instructional permit or a driver’s license until the age of 18.
