What Can Happen if I Violate my Probation?
As part II of our series on probation violations, it is important to understand not just why your probation officer might violate you for failing to fulfill your conviction of probation (see part I) but also what they could do to you. If you are facing a probation violation in Minnesota, it is critical to consult with an experienced criminal defense attorney to know how to handle it.
“Knowing what the Court could do is a critical component of defending you.”
What are the Consequences of a Probation Violation?
The potential consequences of a probation violation include:
Jail or Prison: If found in violation of your probation, you could face all of the time hanging over your head, including jail or prison.
Additional Fines: In addition, there may be fines that were stayed and imposed.
Possible Convictions: There are some circumstances where the Court could accept certain pleas or convictions that could then last forever forever. You could lose Stays of Imposition or Stays of Adjudication as well.
Extended Probation: There are certain violations that could result in extending probation and conditions of release.
Additional Obligations of Probation: In addition to the above requirements, the Court could also require additional obligations including treatment, no use provisions, psychological evaluations, psycho-sexual evaluations and treatment and more.
Another chance or additional Rope: The Court might cut you a break but understand that this often comes with strings and requirements. A future failure could result in an execution of the sentence which means, everything hanging over your head would be imposed.

If you are facing a probation violation, don’t walk into this potential buzz-saw alone. You may very well see not just your probation officer, but the prosecutor and the Judge all lining up against you at the same time. Having an experienced Minnesota criminal defense attorney by your side may be more important than ever.
