After Chauvin Conviction, what Comes Next before Sentencing?
So, Derek Chain has been convicted on all counts. As soon as he was convicted, the State asked that bail be revoked and that he be taken into custody. He was handcuffed right there and lead out of the courtroom. What happens next?
Chauvin will be housed at Oak Park Heights, a maximum security prison, and will be held in isolation for his own safety. He will be held pending sentencing. Sentencing usually takes 6-10 weeks depending upon the conviction. During that time, there will be a pre-sentence investigation, frequently referred to as a PSI. The PSI will include the official report, prior record, sentencing guidelines, and history of the defendant. In this case, it is possible that Mr. Chauvin may be willing to give his account of events. This would be provided to the Judge as well. This is something that would be interested to read.
The finished PSI will be sent to all parties but most importantly to the Judge who has to determine to sentence. He will be sentenced on all three counts. The Judge will use all of the facts in that PSI to make his decision. The presumptive prison commit for the 2nd Degree Murder is 150 months to serve.
