Juries handling criminal cases in Minnesota have to make really serious decisions. This is true whether it is a jury of six in the case of misdemeanors and gross misdemeanors or twelve in the even of felonies. However, the question is . . . how they make their decisions. Watching juries for a quarter century, I have to say that I have seen them regularly use their hearts for more often than using their heads. They may come back and justify but that is different.

“All people are different. All jurors are different. Some are more emotional, some more intellectual. Depending upon the ones you have, tailoring your message can make a difference.”

Jack Rice, St. Paul based criminal defense attorney appears on Court TV with Michael Ayala to discuss juries, what they do, why they do it, and whether it is their heads or their hearts that they use most. Knowing what drives them can impact how you should repent evidence.

“In the end, people frequently decide with their gut. Once they do this, the intellectualize their decisions to justify the answer. It doesn’t mean the ignore facts. The just balance those facts viscerally”

If you are facing serious criminal charges in Minnesota, it is important to consider the kinds of charges and the kinds of facts when picking a determining the right kind of jury. Determining the fact finders may be the most important step in the trial. An experienced criminal defense attorney and Board Certified Criminal Law Specialist can help.
