County attorneys in Minnesota are elected. That's right. You think this doesn't play into the calculus or whether they charge and pursue a case? This is the same for Minnesota Judges. You could argue they are simply politicians in black robes who act like they are above the fray. Are they? What we are really talking about is the fear of pandering and about trying to be popular so they can get reelected.

“If you are asking an elected official to make a decision that could hurt them in the polls, how likely do you think they would be to make that decision?”

Jack Rice, St. Paul, MN based criminal defense attorney is in studio in Atlanta with Michael Ayala at Court TV studios to discuss overreach and what happens when prosecutors make the decisions they do. It is important to always consider this.

“In the end, going to trial is about having a fair opportunity to have your case heard by people who aren’t seeking office, who aren’t seeking votes and who will make a fair decision regardless of the outcome.”

If you are facing serious criminal charges in Minnesota and your concern is that it may be politically driven or inappropriately influenced, sit down with an experienced criminal defense attorney. It may change the complexity of the case.
