Two Felony Case Dismissals in One Day. Not a Bad Day

It’s a really good day. I had a client who was charged with two really serious felonies that easily could have put in him prison. The problem is that the cases were very old and the Government sat on them for a long time before finally charging my client. The problem with that is that if their behavior gets in the way of giving a defendant the ability to defend themselves, the Government may have problems.

In this case, we were in a tough spot and it was difficult to determine which direction to jump. Ultimately, we fought the charges and specifically the Government’s behavior in these cases. Finally, I moved to have both cases thrown out for failure to prosecute. Finally, after a long time, the Government agreed. So, my Client walks without any convictions at all.

Not a bad day . . .
